2021 Legislative Update 01/11/2021

HB 1041

The SD Department of Health has drafted a billl for the 2021 legislative session “An Act to establish the South Dakota Board of Speech-Language Pathology, Audiology, and Hearing Aid Dispensing and to repeal the South Dakota Board of Hearing Aid Dispensers and Audiologists and the South Dakota Board of Examiners for Speech-Language Pathology.”

The Bill Draft was written by the Department of Health to address a priority from the Governor’s office to ensure that licensing boards are running as efficiently as possible. The DOH looked at the professions they license and chose the Hearing Aid Dispensers/Audiology and Speech-Language Pathology boards because many other states license these professions through one board. SDSLHA did not have input into the decision to draft the bill or the initial content of the bill. The intent of the bill, per the Department of Health is to combine the licensure boards. They hope to keep the bill as simple as possible by focusing on only combining the boards, not changing the content of the statutes.

SDSLHA has reviewed the initial draft of the bill and provided input to the DOH via the Executive Director’s office for the 2 licensure boards. SDSLHA has not taken a position to oppose or support the bill, but is requesting input from licensees. We have been informed that the DOH will take the lead to lobby the bill in the 2021 legislative session. Members of the SDSLHA Executive Council will be meeting with the Department of Health to discuss the bill on 01/15/2021.

HB 1014 establish uniform complaint and declaratory ruling procedures for agencies regulating certain professions and occupations.
